Liability Waiver

PARTICIPANT RELEASE AND KNOWLEDGE OF AGREEMENT

1) I wish to participate in the Hero Games. I understand there are inherent risks in participating in a program of strenuous exercise. I agree that Hero Games shall not be liable or responsible for any injuries to me resulting from my participation in the fitness program (whether at home, at the training facility, outdoors, or at a corporate, commercial, residential or other fitness facility) and I expressly release and discharge Hero Games owners, employees, agents and/or assigns, from all claims, actions, judgments and the like which I or my heirs, executors, administrators or assigns may have or claim to have as a result of any injury or other damage which may occur in connection with my participation in the fitness program, excepting only an injury caused by the gross negligence or intentional act of such person or persons. This Release shall be binding upon my heirs, executors, administrators and assigns.

2) I understand that I am not obligated to perform nor participate in any activity that I do not wish to do, and that it is my right to refuse such participation at any time during my training sessions. I understand that should I feel lightheaded, faint, dizzy, nauseated, or experience pain or discomfort, I am to stop the activity and inform my Cadre.

3) I accept responsibility for any cuts, scrapes, and lacerations due to negligence to abide by uniform requirement. I understand that Hero Games and its associates are not responsible.

4) I acknowledge that the hosting facilities/landowners (Johnson’s Family Orchard/Peaks of Otter Winery) and associates (Sharp Top CrossFit) will not be held liable for any actions/events associated with the Hero Games.

5) I understand that Hero Games photographs many of their client events/sessions and I provide written approval for them to use these pictures for promotional purposes.

6) I understand that Hero Games is not liable for any altercation which occurs between participants, and therefore Hero Games will not be partial nor liable to any court proceedings or civil lawsuits associated with such occurrences.

Please understand that despite all the precautions that you, other members, and/or Hero Games may take, we cannot guarantee your health or safety, and you may still be exposed to COVID-19, including through interactions with other individuals who have COVID-19.  By executing this release and gaining access to the facility, you, on behalf of yourself, your heirs, beneficiaries, representatives, successors and assigns: (1) voluntarily assume all risks associated with any exposure to COVID-19, including, but not limited to suffering any type of medical condition, illness and, potentially, death; and (2) knowingly and voluntarily waive, release, covenant not to sue, forever discharge, indemnify, and hold harmless Hero Games, its parents and subsidiaries and their respective officers, directors, employees, contractors, agents, representatives, successors and assigns (“Released Parties”) from any and all liability, damages, losses, suits, demands, causes of action to the fullest extent permitted by the laws of this state, or any other claims of any nature whatsoever, arising out of or relating in any way to your use of the facility and your potential exposure to COVID-19.
